ASSUMPTION OF RISK AND ACKNOWLEDGEMENT
I am aware the use of equipment and participation in activities during the BC trip has, in addition to the usual dangers and risks inherent with these activities, certain additional dangers and risks, some of which include but are not limited to:
TERRAIN – areas used for activities have many obstacles and hazards, which may be hidden or covered by debris.
WEATHER – Weather conditions may be extreme and can change rapidly without warning
ADVENTURE ACTIVITIES – such as attending and participating in the Bus Tour, Sea to Sky Gondola, float plane and fishing activity may result in an accident or injury.
STAFF AND OTHERS – the conduct, including negligence of Ontario Stone, Sand & Gravel Association, its staff, management, board, and all others.
PICTURES AND VIDEO - photos and videos of the trip will be taken for the use of a trip summary as well as for future tour promotion and other marketing.
RELEASE OF LIABILITY, WAIVER OF CLAIMS & INDEMNITY AGREEMENT
In consideration of the trip and activities, I hereby agree as follows:
- TO WAIVE ANY AND ALL CLAIMS that my family or I have or may in the future have against Ontario Stone, Sand & Gravel Association, and all their respective directors, officers, employees, agents, volunteers, representatives, successors, and assigns (all of whom are hereinafter collectively referred to as “the Releasees”) and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury, including death, that I may suffer, or that my next of kin may suffer as a result of/or arising out of any aspect of my participation in trip and activities, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF WARRANTY ON THE PART OF THE RELEASEES in respect of the trip and adventure activities or in respect of the provision of or failure to provide any warnings, directions, instructions or guidance as to the trip, Bus Tour, float plane, Sea to Sky Gondola, Fishing Trip, etc.
- TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any loss, damage, expense, or injury, including death to any third party, resulting from the participation in the trip, and all activities, site tours, and transportation on the trip.
- This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, and representatives in the event of my death or incapacity.
- This Agreement and any rights, duties, and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario and no other jurisdiction; and
- Any litigation involving the parties to this Agreement shall be brought solely with the Province of Ontario and shall be within the exclusive jurisdiction of the Courts of the Province of Ontario.
- By completing this form, you acknowledge that an inherent risk of exposure to COVID-19 and other communicable diseases exists in any public place where people are present. By attending the OSSGA event, you and any attendees voluntarily assume all risks related to exposure to COVID-19 and other communicable diseases and agree not to hold OSSGA, staff, contractors, venues, speakers, tour sites, and/or any of their affiliates, directors, officers, employees, contractors, or volunteers liable for any illness or injury.
- You confirm you have been encouraged and advised to get travel insurance, including cancellation and medical/health.
